Unfortunately, the law in Colorado requires us to name the person or company who injured you as the defendant, as opposed to the insurance company who is actually defending the person or the company. This creates a problem because jurors often times feel the money is coming out of the defendant's pocket when in fact it is the defendant's insurance company that pays any verdict. As a former prosecutor of ten years, and a defense attorney since 1997, I have participated in over 250 jury trials. Through my work on both sides of the aisle, I understand the necessity of an aggressive and competent defense in any criminal case. If the State is trying to convict you of a traffic offense, including drunk driving, you could lose your license, have large fines imposed upon you, be court ordered to alcohol treatment, and even spend time in jail.
